Market surveillance

If you are selling or promoting energy-labelled products, you may be selected for inspection by the responsible national or regional market surveillance authorities.

Market surveillance by the authorities (MSA) serves the goal to check the compliance of products sold on the EU market with the relevant EU legislation and to avoid unfair competition, to marke sure intended energy savings and environmental benefits are met and to make sure  that the requirements of the EU legislation are fulfilled in practice. 

The scope of a market surveillance inspection may vary and can include inspection of your physical shops, webshops, advertisements, materials etc.

It is the formal duty of dealers to cooperate with your national MSA and to take immediate action to remedy any case of non-compliance.

Enforcement

In case of detected non-compliance, the MSAs will require you to take all appropriate corrective actions to achieve compliance with the applicable requirements.

A fine or a removal of the product from your shop could be a consequence, However, the specification of the concrete enforcement measures lies within the responsibility of the EU member states and is done by the specific MSA.
