Scope of the regulation
Only smartphones and slate tablets are in the scope of the energy labelling regulation (EU) 2023/1669 according to article 1.
It is the characteristics of the product that determine whether a product is defined as a smartphone or a tablet, or something different.
A smartphone is defined by the following characteristics:
- Wireless network connection, mobile use of internet services, an operating system optimised for handheld use and the ability to accept original and third-party software applications
- Integrated touch screen display with a viewable diagonal size of 10,16 centimeters
(or 4,0 inches) or more, but less than 17,78 centimeters (or 7,0 inches) - The device has a foldable display or has more than one display, at least one of the displays falls into the size range in either opened or closed mode
A slate tablet (designed for portability) is defined by the following characteristics:
- An integrated touch-sensitive display with a viewable diagonal size greater than or equal to 17,78 centimeters (or 7,0 inches) and less than 44,20 centimeters (or 17,4 inches);
- Does not have an integrated, physically attached keyboard in its designed configuration;
- Primarily relies on a wireless network connection;
- Powered by an internal battery and is not intended to work without battery and
- Placed on the market with an operating system designed for mobile platforms, identical or analogous to smartphones
What is not in scope of the regulation?
The energy labelling regulation (EU) 2023/1669 does not apply to the following products:
(a) mobile phones and tablets with a flexible main display which the user can unroll and roll up partly or fully;
(b) smartphones for high security communication.
Please also note, that computer tablets, second-hand and used products are not in the scope of the regulation.
